The statute
Wis. Stat. § 942.09 (Representations Depicting Nudity)
What it prohibits
Wisconsin bans capturing a photograph, video, or other visual "representation" depicting a person nude or partially nude, without that person’s knowledge and consent, under circumstances where the person had a reasonable expectation of privacy. The law asks whether the person reasonably expected they would not be recorded nude — not merely whether they expected the recorder specifically not to see them. It also separately criminalizes knowingly reproducing an image captured this way. Minors and people with impaired judgment are legally incapable of giving the required consent.
Penalty
Class I felony — a fine up to $10,000, imprisonment up to 3 years and 6 months, or both.
