The statute
W. Va. Code § 61-8-28 (Criminal Invasion of Privacy)
What it prohibits
West Virginia bans knowingly creating a visual recording of another person without consent while they’re fully or partially nude, in a place or circumstance where they have a reasonable expectation of privacy. Knowingly displaying, distributing, or disseminating images known to have been obtained this way is also covered.
Penalty
First offense: misdemeanor, up to 1 year and/or up to $5,000 fine. Second or later offense: felony, 1 to 5 years and/or up to $10,000 fine.
